According to the Law of Labor and Workers, May 7, 2015 will be the due date for the companies to include in their payrolls, those employees working as outsourcing.
The Ministry of Labor is conducting special visits and inspections to the employers to determine possible outsourcing of personnel in violation of the law, and may order the inclusion of these employees on the company’s payroll with the same benefits and working conditions corresponding to the employees of the beneficiary of the outsourced service.
The employer who violates or obstructs the execution of an order from the Administrative Labor Authorities regarding this matter, will be sanctioned with a fine that can range from 120 up to 360 Tax Units (Unidades Tributarias), as well as police detention for a period of 6 up to15 months.
